Withdrawal

The offers of NexGen IT-Security GmbH, in particular consulting services and software licences, are directed exclusively at businesses within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG). When ordering, the customer expressly confirms that it is acting as a business.

The statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG) is available to consumers only. Businesses have no right of withdrawal under the FAGG. The possibility of terminating an order under the License Terms or the Terms & Conditions (e.g. due to a material defect) remains unaffected.

Should a contract nevertheless be concluded with a consumer in an individual case, the following applies:

Right of withdrawal: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (NexGen IT-Security GmbH, Liechtensteinklammstraße 60, 5600 St. Johann im Pongau, Austria, e-mail: office@nexgen-itsec.com, phone: +43 670 350 1599) of your decision to withdraw from this contract by an unequivocal statement (e.g. by e-mail or letter). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated your withdrawal, in comparison with the full coverage of the contract.

Pursuant to § 18(1)(11) FAGG, there is no right of withdrawal for contracts for the supply of digital content not supplied on a tangible medium (e.g. software download) if we have begun delivery – in particular by sending the download link – with your express consent before the end of the withdrawal period, you have acknowledged that you thereby lose your right of withdrawal, and we have provided you with a copy or confirmation of the contract.
